PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS SITE.
Section 1. Content Ownership and Usage

The Vesalius website (referred to as "VESALIUS" herein) is owned and operated by LION REEF SOFTWARE, INC. (referred to as "LION REEF" herein). As a Subscriber, you may download any material on VESALIUS and use it at no charge for non-commercial, short-term educational applications, provided that you keep intact all copyright and other proprietary notices. Modification of the materials in any way, including but not limited to alteration or removal of the "www.vesalius.com" watermark or the "Gary Wind" signature, is a violation of LION REEF's copyright and other proprietary rights.

Examples that meet LION REEF's definition of non-commercial, short-term educational applications are provided below. Vesalius subscribers with unexpired subscription terms are permitted to incorporate Vesalius content in the production of these applications.

• presentations by physicians, healthcare professionals, and students
• presentations to physicians, healthcare professionals, and students
• academic papers or brochures
• temporary educational displays or exhibits
• non-website study materials designed for short-term, non-commercial use

Examples that DO NOT meet LION REEF's definition of non-commercial, short-term educational applications include those listed below. Vesalius subscribers are not permitted to incorporate Vesalius content in the production of these or similar applications without express written permission from LION REEF.

• academic, personal, or commercial websites
• academic, personal, or commercial multimedia applications
• books or publications designed to last through repeated use
• videos and films

In the event you download text, files, images, illustrations, animations, software models, or other data from this site (collectively referred to as "MATERIAL"), LION REEF does not transfer title to the MATERIAL to you. You own the medium on which the MATERIAL is recorded, but LION REEF retains full and complete title to the MATERIAL and all intellectual property rights therein. You may not modify, redistribute, or sell the MATERIAL under any circumstances without express written permission from LION REEF.

If you are uncertain whether your usage of downloaded Vesalius content qualifies as a non-commercial, short-term educational application, please send e-mail to:

Section 2. Subscriptions

Subscriptions to VESALIUS are prepaid and NON-REFUNDABLE. Your subscription entitles you to full use of VESALIUS for the duration of the subscription term. Should you wish to terminate your subscription prior to the completion of this term, LION REEF will promptly remove your personal information from the VESALIUS subscriber database, provided that you request this in writing and send your request to LION REEF via fax or postal mail.

Notwithstanding the foregoing, IN NO EVENT SHALL LION REEF BE LIABLE TO YOU FOR ANY UNUSED PORTION OF YOUR SUBSCIPTION TERM. REGARDLESS OF THE DURATION OF YOUR SUBSCRIPTION OR THE DATE OF YOUR TERMINATION, LION REEF WILL NOT BE OBLIGATED TO REFUND ANY PORTION OF YOUR SUBSCRIPTION FEE.

When your subscription term is within 10 days of expiration, you may be sent an e-mail message reminding you to renew your subscription. If you choose not to renew your subscription, your access to VESALIUS will be limited to that of non-subscribers as of the day expiration of your subscription term. If you choose to renew or extend your subscription, the number of days in your new subscription term will be added to the number of days remaining in your current term.

Section 3. Quizzes and Mark-Ups

The Quizzes and Mark-Up services on VESALIUS allows Subscribers to annotate VESALIUS images with draggable icons and text comments, and then store these marked-up images and text in a private archive on the VESALIUS website. By subscribing to use VESALIUS, you agree not to use the VESALIUS Quizzes or Mark-Up capabilities:

a) to impersonate another person, or to allow any other person or entity to use your identification to post or view your Quizzes or Mark-Ups.

b) to publish material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;

c) to publish material that is obscene, defamatory, threatening, harassing, or abusive to any other person or entity as determined by LION REEF at its sole discretion;

d) to publish advertisements or business solicitations;

e) to publish pyramid schemes or chain letters;

f) for any purpose in violation of local, state, or national laws;

LION REEF does not examine Quizzes or Mark-Ups published by Subscribers and is not responsible for screening or monitoring material posted by Subscribers or any other person or entity. If notified by a VESALIUS user of Quizzes or Mark-Ups which are alleged not to conform to the terms of this Section, LION REEF may investigate the allegation and determine in its sole discretion to remove or request the removal of the Quizzes or Mark-Ups. LION REEF reserves the right to remove Quizzes or Mark-Ups that violate the terms of this agreement. LION REEF HAS NO LIABILITY OR RESPONSIBILITY TO ANY VESALIUS SUBSCRIBERS OR OTHER VIEWERS FOR ANY FAILURE TO PERFORM EXAMINATION OR SCREENING OF CRITIQUES OR MARK-UPS.

LION REEF does not represent or guarantee the accuracy or reliability of any Quizzes or Mark-Ups created and/or published by Registered Users, and YOU ACKNOWLEDGE THAT ANY RELIANCE ON THE CONTENT OF SUCH QUIZZES OR MARK-UPS IS AT YOUR OWN RISK.

By becoming a VESALIUS Subscriber, you are agreeing to all of the aforementioned terms for the use of Quizzes or Mark-Ups contained in these Terms of Use.

Section 4. Advertisements

VESALIUS contains advertisements and sponsor logos from third parties, as well as links from these advertisements and sponsor logos to third-party websites. LION REEF does not endorse any product, service, or company, or make any representation regarding the content or accuracy of any materials contained in, or linked to, any advertisement or sponsor logo on VESALIUS.

Section 5. No Warranty

While the MATERIAL on VESALIUS has been derived from and produced by certified medical professionals, VESALIUS SHOULD NOT BE CONSIDERED AN AUTHORITATIVE SOURCE OF MEDICAL OR SURGICAL INFORMATION, AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL INSTRUCTION OR ADVICE.

While LION REEF has taken reasonable precautions to protect the MATERIAL on VESALIUS and the VESALIUS servers, LION REEF does not warrant that VESALIUS will be free of harmful bugs or computer viruses. The Internet is an inherently unreliable and unpredictable medium. LION REEF does not warrant that VESALIUS, or any of the content in the VESALIUS Clinical Folios, or Mark-Ups stored on VESALIUS will be continuously available to you or to other viewers on the Internet, or that VESALIUS will operate reliably or without interruption.

While LION REEF has undertaken reasonable efforts to ensure that the VESALIUS Mark-Up and Quizzes capabilities work as described on VESALIUS, LION REEF EXPRESSLY DISCLAIMS ANY WARRANTY THAT THE CONTENT OF ANY MARK-UPS OR QUIZZES WILL BE FAITHFULLY AND ACCURATELY REPRODUCED.

TO THE FULLEST EXTENT PERMITTED BY LAW, LION REEF DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. LION REEF MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT, ARTWORK, GRAPHICS, MEDICAL IMAGES, DESCRIPTIONS, AND LINKS ON VESALIUS.

LION REEF SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE VESALIUS, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LION REEF IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT THAT LION REEF IS FOUND LIABLE FOR ACTUAL DAMAGES INCURRED BY YOU DUE TO GROSS NEGLIGENCE OR WILLFUL MALFEASANCE BY LION REEF, LION REEF'S OBLIGATION TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LION REEF DURING THE PRECEDING 12 MONTHS.

LION REEF makes no claims that the MATERIAL on VESALIUS is appropriate or may be downloaded outside of the United States. Access to VESALIUS may not be legal by certain persons or in certain countries. If you access VESALIUS from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

The information provided on VESALIUS is designed to support, not replace, the relationship that exists between a patient/site visitor and his/her physician.

If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. THESE TERMS OF USE CONSTITUTE THE ENTIRE AGREEMENT BETWEEN YOU AND LION REEF WITH RESPECT TO THE USE OF VESALIUS.
